- The applicant is the owner of land known as Lot 3 DP 170234 being 228 Skye Point Road, Coal Point ("the subject land") which is situated on the western shore of Lake Macquarie. Erected on the subject land is a dwelling ("the dwelling"), the eastern projection being located approximately 7 m west of the high water mark. The dwelling extends in a westerly direction to a point which is approximately 26 m from the high water mark of Lake Macquarie.
- The applicant lodged development application D/2000/2059 dated 10 November 1999 ("the development application") with the council on 24 November 1999 proposing 'house additions' to the dwelling. Plans submitted with the development application indicate that the house additions are proposed approximately 13.5 m from the high water mark.
