- The Applicant is to pay the Respondent's costs thrown away in accordance with s 8.15(3) of the Environmental Planning and Assessment Act 1979, as agreed or assessed. 2. The objection pursuant to cl 4.6 of the Woollahra Local Environmental Plan 2014 to vary the building height standard at cl 4.3 of Woollahra Local Environmental Plan 2014 is upheld. 3. Development consent be granted to Development Application No. DA13/2019/1 for demolition of the existing buildings, and construction of a new residential flat building with underground parking, new landscaping and strata subdivision, and remediation of land, at Nos. 590-592 New South Head Road, Point Piper subject to the conditions in Annexure A.
