Taxation - First Home Owner Grant Act 2000 (Vic), section 48(2) - Whether first home owner grant was paid as a result of the applicant's dishonesty - Whether Tribunal has power to order repayment of grant by instalments - Whether Tribunal has power to vary decision in relation to interest.
Green v Commissioner of State Revenue (Review and Regulation) [2018] VCAT 640
The decision of the respondent is varied to reduce the penalty to nil.
... while this Tribunal can re-examine whether, on the evidence before it, there was fraud or evasion, and can substitute its opinion for the Commissioner's, the issue for this Tribunal is whether the taxpayer has discharged the onus of showing that the fraud or evasion opinion should not have been formed. If a taxpayer does not do that, the amended assessments stand.[19]
... the Tribunal must feel an actual persuasion of its occurrence or existence before it can be found. It cannot be found as a result of mere mechanical comparison of probabilities independently of any belief in its reality.
... The seriousness of an allegation made, the inherent unlikelihood of an occurrence of a given description, or the gravity of the consequences flowing from a particular finding are considerations which must affect the answer to the question whether the issue has been proved to the reasonable satisfaction of the Tribunal.
In such matters 'reasonable satisfaction' should not be produced by inexact proofs, indefinite testimony, or indirect inferences.[21]
dishonesty is to be determined by reference to the current standards of ordinary, honest persons, and by asking whether the act in question was dishonest by those standards and whether the accused must have known it was so.[30]
A reckless disregard or indifference involves, at the least, a subjective element of actual conscious disregard of or indifference to the risks created by the conduct.

[28] Ibid [26(b)]. As this indicia was not raised in the determination of the objection, to the extent the indicia are 'grounds', the Commissioner sought leave to raise it under section 31 of the FHOG Act. I do not consider it necessary to grant leave as I accept the Commissioner's submission that the identified indicia are just particulars of the ground of dishonesty.

[37] Much of what follows is drawn from the Applicant's unsworn witness statement dated 8 January 2018 (AWS), supplemented by her oral evidence.
[41] A copy of the loan contract dated 8 May 2015 was included as one attachment in the email from Ellinghaus Weill dated 8 January 2018 forwarding the AWS. For convenience, the Commissioner collated all the attachments to that email in a folder entitled 'Applicant's Materials' (AM), with the loan agreement at Tab 7.
