This is a trial of limited issues in three actions, following an order by Moynihan SJA (under O.39 r.12) directing that the trial of liability issues be heard separately from the trial of quantum issues. On 19 December 1997 further directions were given as to whether certain issues were or were not embraced by the direction, and the trials have proceeded on the issues as defined in that further order. The trial has taken 15 days.
Similar questions arise in each case, and most of the evidence is admissible in all three cases. In this judgment I shall set out at length the relevant common evidence and findings thereon[1], and then proceed to make additional specific findings applicable to these particular plaintiffs. In the other cases I shall adopt these common findings, and proceed to further findings with respect to those claims.
