The victim stated that she was at the location when she was approached by the POI who is her ex husband. The victim and the POI separated in January 2019 and the separation has been less than amicable, and due to such the victim and the POI are currently involved in Family Law issues and property settlements. There are three (3) children involved. When the POI approached the victim he has verbally abused her in relation to the children and pending Court matters. The victim became upset and was feeling harassed and as such reported the matter to Police. The victim informed Police that her solicitor in March made an application for a domestic apprehended violence order which is back before the Court on the [/]08/2019, however there is no enforceable order in place at the current time. Police have insufficient grounds to apply for an urgent order as there are no immediate fears for the safety of the victim. At this point Police wont (sic) be investigating the matter further unless further incidents occur ...

Male: Yeah, that's fine. Look I think it's in both of our best interests if you want to try to organise anything out of court, just let me know if there's anything you want to try to organise so we...
Female: I want to do everything, I wanted to go through mediation with you, but you got me into court, so [9:00] I wanted to go to mediation so we didn't have to keep bringing in court at all.
...
Female: Okay, you talk to the lawyers, I think we should keep it with the lawyers, okay...
Male: Well, if you want to continue that, I'll call the [Country EE] Federal Police, your mother will get done for fraud, she'll possibly go to jail, she won't be allowed out of the country, she'll never see the kids again.

[Mr Golly] stated that the couple weren't in love and he is unsure why they remained together for so long or made the decision to have more children. [Mr Golly] reflected that he should have listened to his mates and ended it sooner.
CHILDREN'S BEHAVIOURS AND DISCLOSURES FROM JULY 2019
From in or around July 2019 until March 2020, I was in a relationship. I was always present when [Mr M] was around the children. There was no occasion when the children shared a bed with [Mr M] or with [Mr M] and I together.
...
She said that recently they had gone to a family day for Halloween and she took pictures of her new partner with the kids and posted it on Facebook. She said that by the time she got home she had about 60 messages from a female saying that she was the mans ex. There were texts saying that he is cheating on her and then threats that she would harm her and her children. [Ms Wolberink] said that she told her partner and he said that when he got home all of his front windows were shatterd and broken with blood on them etc. [Ms Wolberink] said that she told him to call the police and he said that he did and that they have granted him an AVO for 12 years. She said she wasnt sure if this was true and that he couldnt show her the paperwork.
She said that she cant take the messages to police as she cant have an AVO whilst going through family Law.
Counsellor will do an MRG on the list when she sends it via email and will send her some ideas around books that can be helpful in talking to the children about the safety of their body.

- [Ms Wolberink] said that it feels as though he promises things constantly but these things dont eventuate.
- She gets confused about whether there are red flags or she is being paranoid
- He has invited himself to her trip home to [Country J] and has changed the whole season that she was going to go to suit himself even though he wasn't invited.
- [Ms Wolberink] said that the boys have become very attached to [Mr M] and that she doesn't want to hurt them. Discussed what might be the effects if this in fact is a perpetrator of abuse given there are many red flags. [Mr M] told [Ms Wolberink] that the way to her heart was through her children.
- [Ms Wolberink] said that she didnt want to introduce the children to [Mr M] so soon but he insisted saying that if he couldn't be in the relationship 100% he didn't want to do it at all. [Ms Wolberink] speaks of wanting space and feeling smothered by him

She tells [X] that he shouldn't cry or he is a girl and that he should fight like a boy with his brothers and encourages them to do so. She wasnt sure if that was a normal developmental phase typical for boys or was there something more concerning to it.
- Counsellor suggested that it may be beneficial for [X] to see a child psychologist to work with him usig play etc to understand his aggressive behavior.

[Ms Wolberink] stated that recently the two eldest boys were in the shower and came out afterwards to the family area. [Ms Wolberink] said she had a friend visiting and when the boys came out the [sic] were repeatedly saying, "dingy in the bum, dingy in the bum", with one child standing close to the other. [Ms Wolberink] said that she was so embarrassed at this behaviour and what the boys were saying that she tried to stop the behaviour as soon as possible.
...
Since then the caller hasn't witnessed any other incident but has heard things happen and they feel that things have happened. The caller feels that abuse is happening because [X] has told them that his father has hurt him and the caller has sometimes heard [Mr Golly] screaming at [X]. The caller has heard a bang once in 2018 and they ran into the room and [X] was on the ground crying. The caller thinks that [Mr Golly] pushed him off the bed because they heard [Mr Golly] say "ow you nearly broke my nose" and that is when the caller heard the bang and they heard [X] crying and when the caller went over, [X] was on the ground looking frightened but he didn't tell the caller what happened and didn't want comfort from his father after that.
...
When asked if there are sexualized behaviours the children are displaying, the caller said that an (sic) report has already been made by [Ms JJ] from [U Counselling Service] where [X] was making sexualized comments.

On Tuesday the [...] of December 2020 FACS and Health met with [Ms Wolberink], the mother of the victim and provided information in regards to a number of issues including legal processes and children behaviours, along with strategies to support her and the children.
It was explained Police would not continue to endlessly interview children when it was evident they were not ready to speak. The victim has previously been interviewed twice already and Police are mindful of the harm this can cause children if further interviews are conducted.
...
- M feels like the trust between her and the children has been damaged by her trying to get them to tell proffessionals what has happened to them.
- M has been working with the Health Clinician around the boys sexual behavior and although its been very helpful she wonders if it suppressing their feelings and denying them the ability to act out what is happening to them by their Dad.

...
- On 13/7/21 [Y]and [Z] were interviewed together. During the interview, [Y] was asked "I have been told that some put something in your bottom?" [Y] replied, "Well sometimes my dad does". [Y] was asked 'Why?" [Y] replied "I don't know - because he likes my bum bum." [Y] was asked follow up questions in relation to time frames, but [Y] was unable to advise. [Y] did advise that this had not occurred to his brother's [X] and [Z]. [Y] also advised that he had not told his mother about his father 'puts finger in his bottom. [Y] was asked "Do you want me to tell dad to stop putting his finger in your bottom?" [Y] said "Yes, I want it to stop. But tell my dad that he is not my real dad." Case workers are unsure what [Y] was refereeing (sic) to re his father not being 'his dad'. [Y] was asked, "Did anyone see you day put his finger in you bottom?" [Y] replied, "No, Only me. Are we done yet." [Y] became restless, disengaged and distracted and was unable to answer further questions so the interview was ended so as not to distress [Y] and [Z].

...
- As the interview with [Y] and [Z] was coming to a close, the children began getting restless. They had been engaging with CW's for one and a half hours and CW's were waiting for [Ms Wolberink] to return to collect them. In the family room where the interview took place, there was a giant life sized teddy bear. [Y] retrieved the bear and placed it on the couch. He proceeded to stand in front of the bear and make 'grinding' actions on the bears face with his crutch. [Z] saw this and joined in. They boys began to tussle over the bear and it ended up on the floor. Both boys sat on the bears face and began grinding their crutch against its face. CW's asked what they were doing and why they were doing that and they both stated they 'liked it' whilst laughing. [Z] then moved to the crouch area of the bear and continued to grind his crouch into the bear. The bear was observed to be face up and both boys had positioned themselves over the bears face and crutch area. They boys were observed to be heightened at this time, running round the room, laughing, yelling about their bottom and fighting over the bear.
- Following their mother arriving, one CW remained in the family room to speak with her while the other CW took the children to meet the mothers support person [Ms P] in the foyer of the CSC. While the CW was speaking to [Ms P], [Z] and [Y] were running around the foyer. [Z] proceeded to come up to the CW, bend over and poke his bottom with his finger. [Z] stated "bum bum bum, I like it'. [Y] then proceeded to copy this and the boys began running round the room saying 'bum'. It took [Ms P] and the CW a number of minutes to calm the boys down and redirect them into an activity. It was noted that when both [Y] and [Z] left CSC they appeared happy and quite talkative giving both CW 'high fives' as they left ...
...
A number of the aforementioned factors have been noted in the relationship between [Ms Wolberink] and [Mr Golly]. Specifically, during the course of the investigation both parents have, on at least once occasion, recorded the children answering questions to the effect of, 'had dad ever touched your bottom'. In the video recently presented to CW's by [Mr Golly], he was asking [Y] about the suspected abuse. The video shows [X]* (sic) looking tired, frustrated and annoyed at the questions. [Mr Golly] was using leading questions and was noted to ask similar questions a number of times. In a previous investigation [Ms Wolberink] submitted an audio file whereby she was asking questions in [Country J Language] about the abuse that was translated, appeared she was also using leading questions.
...
From the information received, is clear there are significant challenges in [Ms Wolberink] and [Mr Golly]'s relationship which may correlate to the presentation of sexualised behaviours, hyperactivity and developmental regression in [Y] and [Z] and learning and developmental concerns in [X]. As such, in lieu of forensic evidence, JCPRP have been unable to pinpoint the exact cause of these behaviours however, have indicated that they may, in large part, be related to psychological harm, resulting from the parent's separation and current behaviour.
...
On the balance of probabilities with the evidence currently available, [Town G] JCPRP have substantiated;
- SEXUAL ABUSE: Suspicious indicators consistent with sexual abuse for [Y]. (JCPR are not able to determine with certainty if the partial disclosure/ behaviours of [Y] are a direct result of being sexually abused or if his partial disclosure/behaviour relates to trauma associated with the breakdown of the relationship between his parents ...
- PSYCHOLOGICAL HARM: Risk of significant psychological harm by both [Ms Wolberink] and [Mr Golly] towards [X], [Y] and [Z]...

As LWP and the worker looked over to [Z], [Z] began to pull the front of his pants and undies down and LWP immediately walked over and pulled [Z's] pants up telling him that what he was doing was inappropriate. [Z] smiled and laughed.

[X] a few times smacked [Y] on the bottom whilst smiling and STP asked [X] not to do that to his brother.

- Immediately on return to the room with the mother, [X] approached the writer and stated "I think he was the kindest he has ever been because you are here". The mother looked at [X] and appeared to attempt to diffuse this, stating "Oh [X]" and tutting.
[Z]: "My dad says he hates my mum"
Me: "And what does mum say?"
[Z]: "Oh, she doesn't say she doesn't like my dad, but I know. I just know. Dad said we are going to live with him soon. He is going to get a bigger house for us and we will live with him. We only stay with dad one night then two nights and then we go home to mum. Dad doesn't like it and said we have to live with him and only see mum sometimes".

What is the cause of the children's sexualised behaviour?
It's hard to grapple and hard to decipher, and to really understand what has happened in the context of the increasingly sexualised behaviour. It may be a bit of a cascade effect, that these children have inadvertently been allowed to perpetrator (sic) sexual abuse between one another and that will have escalated the sexualised behaviours, and so that's why we're seeing them continue. It's - it's most often the case that children have been exposed to or experienced some form of sexual harm to present with sexualised behaviours. But again that's - that could be in a multitude of settings. It could be by, you know, a number of different exposures or experiences, in a friend's home, in a - in a - in a school setting with a peer, with a parent, with a - some teacher. You know, it's - but certainly the - the - the manner in which the children have continued to display these sexualised behaviours would indicate that there has - that there has probably been the opportunity for the children to continue to perpetrate those behaviours upon one another and so this behaviour hadn't been - by parental sort of management of the behaviour.
Exposure to false beliefs that they have been sexually abused
Does the mother believe the father has sexually abused the children?
My sense of the mother's interpretation of the sexual abuse is that it has been clouded by the court proceedings and that she - my sense is she genuinely believes the children are behaving in a sexualised manner and that the court proceedings have constrained her ability to share these concerns because of the implications on how it may appear in relation to - to her actions as a parent.
...for a parent that finds themself in a situation where there are sexual abuse allegations, we live in a society where, you know, under the - the legislation and the authorities, we have to work within that system. She's constrained, as any parent would be, by the constraints of the system. If the children are not making disclosures to the relevant authorities and no evidence has been found, I think it's a general assumption that the more the allegations are made the more that - that, you know, it can appear that that person is causing harm to the children. So there are constraints in that, and it makes it very complex for a parent that finds themself in that situation.
...sense was that the mother held the belief that her primary care of the children was at risk was she to remain strongly - you know, she continued to strongly hold the views that the children were at risk of sexual harm. So my sense was that she was concerned about the impact on her relationship with the children and the care arrangements.
Does the mother have the parenting capacity to protect the children from each other?
...based upon the continued impact on these children in the event that they do not experience any relief from the pressure that has been placed upon them in the context of a high conflict parenting dispute where their daily lives are likely to consistent (sic) of divided loyalties and being expected to focus on matters that are not within the realms of what a child of their age - any child should be expected to manage. And I think the length of time in which this matter has continued and the entrenched nature of the parent's views, to me, portrays a pattern that it's unlikely - it's not likely to shift in my experience, in my opinion. And the adverse impact on the children and particularly given their complex needs is such that I don't think the outcomes for the children will be best met if they continue to be exposed to this - these scenarios.
... the parties' positions remain somewhat entrenched, but a grim landscape presented by the single expert may not be as grim as that, in that, like a lot of these matters, when the litigation is finished the parties then are faced with getting on with parenting. It's submitted the independent children's lawyer proposes that, through this minute, the parties have the opportunity to do that. To do otherwise would be to effectively cut off one parent from the children.
