Gadzhis v Stonnington CC [2008] VCAT 1212
951 - 955 Dandenong Road, Malvern East: Sheets 6 - 10 inclusive dated October 2007
"1. Before the commencement of the use and development, three (3) copies of plans drawn to scale and fully dimensioned, must be submitted to and approved by the Responsible Authority. When approved, the plans will be endorsed and will then form part of the permit. The plans must be generally in accordance with the plans advertised plans noted as Amendment No. 4 and received by Council on 9 May, 2007 and substituted plans as circulated to the Tribunal (drawing no. 6,7,9 and 10 revision 5) dated October 2007 but modified to show:
"3. The café, function centre and gymnasium / multi purpose room must at all times operate as ancillary to the principal Motel use."
Amendment to an existing permit for a Motel to provide reconfigured floor layout to all levels, including provision for outdoor courtyard at ground level. The number of bedrooms and car spaces is to remain the same, but reconfigured to enable a more logical layout to the building and an updated façade. Conference and dining facilities at ground level are re-arranged and now include a ground floor courtyard access from the conference room. The conference room is increased marginally in size. The amendment also includes provision of an additional level referred to as "roof terrace". This level includes a gymnasium / multi purpose room with kitchenette, toilet facilities and outdoor terrace area that encircles the room. Measured from plan this room has an area of 12m x 21.8m.
Section 79 Planning and Environment Act 1987
Site area 1766 sqm ( 33.53m x 52.29m), with frontage to Dandenong Road. The site is currently vacant with preliminary earthworks having commenced for the existing approved Motel on site. To the south east are 7 double storey apartments and to the north west is a single dwelling which has a current planning permit application for student accommodation. Further north west is a Masonic Hall with a height of 11 metres.
A laneway abuts the rear of the site with single storey residential dwellings to the rear facing Warley Road and Moama Road.
South west of Dandenong Road is parkland and the edge of the Caulfield Campus of Monash University.
The site has a current existing permit for a Motel comprising 65 bedrooms, 60 basement car spaces and ancillary conference and café dining facilities. The permit was approved on 10 January, 2005. This was subsequently amended to realign the basement car park on 26 February 2007. An extension of time to the permit was also granted on 10 January 2008 for works to finish within 2 years from the extension of time being granted, (with earthworks already commenced).
Do the amended plans constitute Visual Bulk to adjoining properties?
To ensure that the height of buildings respects the existing or preferred neighbourhood character.
Any relevant neighbourhood character objective, policy or statement set out in this scheme.
The effect of the slope of the site on the height of the building.
The relationship between the proposed building height and the height of existing adjacent buildings.
The visual impact of the building when viewed from the street and from adjoining properties.
Will the use of the upper level cause unreasonable amenity impacts to adjoining properties?
Will the ground floor courtyard cause unreasonable amenity impacts to adjoining properties?
[1] In accordance with Section 4 (2) (d) of the Victorian Civil and Administrative Tribunal Act 1998 a failure to make a decision is deemed to be a decision to refuse the application.
[2] The existing condition 6 provides for a landscape plan to be submitted which has now been submitted with the amended plans and is to be further amended through the amended Condition 1.
[3] There is minor intrusion into the ResCode envelope at lower levels, particularly to Dandenong Road frontage however the existing approved plans already provide for similar intrusion. The intrusion is also generally to the front of the property where there is least amenity impact to adjoining properties.
[4] This is larger than the proposed function room area on the ground floor.
[5] I do note the kitchen is relatively small and not suited to catering for large-scale functions.
