FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (DIVISION 2)
Note: The form of the order is subject to the entry in the Court's records.
Note: The Court may vary or set aside a judgment or order to remedy minor typographical or grammatical errors (r 24.04(g) Federal Circuit and Family Court of Australia (Division 2) (General Federal Law) Rules 2025 (Cth)), or to record a variation to the order pursuant to r 24.04 Federal Circuit and Family Court of Australia (Division 2) (General Federal Law) Rules 2025 (Cth).
r 24.04 of the Rules. That provision says relevantly:
The Court may vary or set aside a judgment or order after it has been entered if:
(1) Whether the applicant had a reasonable excuse or explanation for not turning up to the hearing;
(2) Whether any prejudice would accrue to any person if the proceedings were reinstated, although I am also conscious of the prejudice to the applicant if the matter is not reinstated; and
(3) The merits of the underlying application, which necessitates consideration of the applicant's prospects of succeeding if they were allowed to go ahead with their application for judicial review.
(1) He was not treated fairly by the Tribunal;
(2) The Tribunal failed to consider his personal reasons; and
(3) The Tribunal failed to consider whether the applicant would face a real risk of significant harm.
SHOULD THE DISCRETION TO REINSTATE BE EXERCISED?
Does the applicant have a reasonable excuse for the absence from the hearing which led to the dismissal orders?
Is there any prejudice that might accrue to another party if reinstatement were ordered?
The merits of the underlying application for review
