REASONS FOR DECISION
- Mr Stuart Fraser appeals against the decision made on 31 October 2019 to affirm a decision by the respondent SafeWork NSW to refuse access under the Government Information (Public Access) Act 2009 (the GIPA Act) to information relating to an incident on 27 March 2017 involving a garbage truck operated by Blacktown City Council (BCC).
Background
- In his initial access request the appellant had requested access to the complete list of questions put to, and the full reply by, BCC concerning the investigation into the fatal accident in which a motorcyclist died in a collision with the garbage truck, and the outcome and decisions made. The Tribunal Member described the appellant's interest in the information as arising from the road safety research work with which he is involved.
- The respondent provided some information, but redacted other information. A request for internal review was limited to the decision to the extent that access was refused to the answers provided by BCC in response to a Notice issued by a SafeWork Inspector under s 155 of the Work Health and Safety Act 2011 (the WHS Act). The respondent contacted BCC which advised that it did not consent to the release of the information, a position it has maintained, including during the appeal.
- The internal review affirmed the original decision. The Information Commissioner on review concluded that the decision was justified and made no recommendation.
