Application under section 79 of the Planning and Environment Act 1987 for review of the failure to grant a permit within the prescribed time.
Flemington Development Pty Ltd v Moonee Valley CC [2010] VCAT 1760
The decision of the Responsible Authority is set aside. In permit application MV/19743/2008 a permit is granted and directed to be issued for the land at 1 Ascot Vale Road, Flemington. The permit allows Construction of a multi storey building for dwellings, serviced apartments, home offices, food and drink premises, convenience shop and restaurant, the use of the land for food and drink premises, convenience shop and restaurant, a reduction in car parking requirements, alteration of access to a road in a Road Zone Category 1, a waiver of a loading zone and associated works in accordance with the endorsed plans and subject to the conditions set out in Appendix A.
Mr Nicholas Tweedie, Barrister, instructed by Evans Ellis Lawyers.
Mr C Townshend , Barrister, instructed by DLA Phillips Fox Solicitors.
The proposal is to develop the land with a 21 level building and to use the building for
219 dwellings, 92 serviced apartments, 6 home offices and retail premises (Food and Drink Premises, Convenience Shop and Restaurant);
Application under section 79 of the Planning and Environment Act 1987 for review of the failure to grant a permit within the prescribed time.
The subject land is a triangular lot located at the intersection of Ascot Vale Road and Epsom Road in Flemington. The land is occupied by the now derelict Racecourse Hotel. The Land has an area of approximately 3700 square metres.
The purpose of the concept appraisal is to enable the proposal to be assessed by a multidisciplinary panel of experts with skills and expertise in planning and related fields, such as urban design and architecture, land economics, social research, transport planning and engineering. The PDP's expert advice is intended to accompany the application through the planning permit process and help inform any future decision making.
The PDP did not endorse the 27 level proposal without further design development. However, we think that elements of their conclusion are relevant to the current proposal which has been prepared, in part, in response to their observations ie:
There is strong policy support within State and Local Planning Frameworks for substantial mixed use development to occur in this location and strategic opportunity for a 'gateway' or 'landmark' building to be delivered. The site is strategically located within the Racecourse Road Activity Centre, and sits in a built form context which is expected to undergo substantial change with significant opportunities for medium and high density redevelopment also surrounding the site. Previous planning applications have recognised the strategic opportunity presented by the site for development that delivers housing and other commercial uses and which strengthens the role of the centre - the current proposal should be offered a similar level of policy support. Furthermore, the site is fortunate in that it enjoys a location and orientation such that offsite amenity impacts of a significant development are minimal or can be managed through design.
... Given the strategic location within an activity centre, and position within an evolving built form context, it is suggested that the site should be able to accommodate development of around 20 storeys, subject to design ...
The issue of height should not necessarily be the determining factor in whether the building represents an appropriate urban design response. The quality of design will be critical - particularly the way the building touches the ground. ...
Furthermore, because the development will be visually exposed and the site has such an important role to play in creating an identity for the centre, the redevelopment will need to provide a truly great building of exceptional architectural quality. ....[2]
In general, we feel that the design has certainly improved. The proposed composition of elements and architectural expression is clearer and is supported by improvements at ground level and the public realm. The proposal offers a more considered outcome in terms of urban design and architectural quality and, subject to further monitoring and review of the issues outlined above, is likely to contribute in a positive way to the surrounding precinct.
The Moonee Ponds Principal Activity Centre is 2.3 km to the north of the site along Ascot Vale Road. This is the primary activity centre for the City of Moonee Valley and offers a range of commercial and retail services.
Figure 3 below is a drawing use by the architects to explain how, in their opinion, their approach to the massing of the building using these various elements, results in an appropriately articulated and site responsive building.
The issue is not so much whether or not the site is appropriate for a more intensive form of development, rather it is whether or not this particular proposal is sufficiently site responsive. The question is does this particular development achieve appropriate balance between these diverse aspirations.
The proposed building will undoubtedly punctuate the skyline view from more view distant vantage points, but this will occur in context where somewhat isolated taller buildings already punctuate more distant views.
As such it is considered that there is sufficient policy support for the proposed service apartments.

[15] The accuracy of the illustrations is limited by the simplicity of the technique used to modify the original perspective rendering. The illustrations assume that the modifications are achieved by a simple reduction in scale of the proposed building. We also indicate the number of dwellings in each option, based on the same assumption, and assuming that the other use components of the building remain unchanged.

[17] In any event, because of the crisis in affordability, apartments are increasing being occupied by families, the larger apartments proposed here can be used for this purpose.
