[2011] VCAT 965
appellant. Decision of Responsible Authority affirmed. Permit must not be granted.
A property owner wanted to build a two-storey house at the back of their existing home in Bentleigh East. The local council refused permission, and the owner appealed to VCAT. The Tribunal agreed with the council and refused the permit. While building a second storey at the rear wasn't automatically banned, this particular design was too bulky and would overshadow the neighbours. A large wall on the boundary would look directly into the neighbour's backyard, and the roof design was out of character with the street. However, the Tribunal did approve of the car parking arrangement at the front, because keeping the old house had benefits for the street appearance and environment.
