6. Mr Distefano completed his induction training on 10 April 2023.
7. Mr Distefano's training in relation to refuelling the burner consisted of a walk through provided by the Venue Manger which included a demonstration on how to undertake the task and a caution not to fill up if there was (sic) any flames.
8. Mr Distefano was not provided with any form of written or documented safe work procedure in relation to refuelling the burner.
EcoSmart XL Series Burner
9. The 2009 EcoSmart XL Series Burner (the burner) is bioethanol fuelled and designed to generate a decorative flame that is not intended for heating.
10. The burner was purchased and installed at The Gully Public House & Garden during a renovation undertaken in 2009.
11. The burner was subsequently moved to its current location (beer garden) following another renovation in 2014.
12. When the burner was purchased in 2009, an Installation, Operation and Maintenance Manual recommended use of a 5L Jerry Can with Safety Spout.
13. The defendant does not believe that it was provided with the Installation, Operation and Maintenance Manual at the time of installation in 2009 or when the burner was subsequently moved in 2014.
14. The burner had applied to it a manufacturer's label referring to instructions before installing or operating noting that the instructions are available on www.ecosmartfire.com.
The Other Workers Exposed to the Risk
15. Between 2009 and 2023, the defendant engaged a number of other workers, including Aaron Little (Mr Little), Bonnie Oritz, Courtney Morris and Kristy Matthews, who were all required to refuel the burner.
16. The other workers were not provided with any form of documented safe work procedure in relation to refuelling the burner.
The Incident
17. At around 4:46pm on 2 June 2023, staff member Mr Little was directed to refuel the burner.
18. Mr Little did so by retrieving a 25L plastic fuel container with a flow control nozzle from the storage room and carrying it to the location of the burner.
19. Mr Little poured fuel onto the burner using the 25L plastic fuel container's flow control nozzle.
20. At around 4:51pm, Mr Little used a lighter to ignite the burner.
21. At around 5pm, Mr Distefano commenced his shift at the premises.
22. By around 5:10pm, the burner had no visible flame emanating.
23. At around 5:20pm, Mr Distefano was directed by staff member Bonnie Oritz to refuel the burner.
24. Mr Distefano retrieved the 25L plastic fuel container from the storage room and carried it to the burner.
25. Mr Distefano then poured fuel onto the burner using the 25L plastic fuel container's flow control nozzle.
26. Almost immediately, the fuel ignited causing a flash flame.
27. It is possible that the burner had not cooled sufficiently so as to ignite the fuel or vapour, or alternatively, that a small flame was still alight at the base of the burner.
28. As a result, Mr Distefano was burned by flames which were then rapidly extinguished using a chemical fire extinguisher.
29. Mr Distefano was treated at the scene by emergency services before he was transferred via SAAS to the Royal Adelaide Hospital.
Prior convictions
30. Winona Way Pty Ltd has not previously been charged or convicted under the Work Health and Safety Act 2012 (SA).
The daily medications I rely on come with serious and ongoing side effects that effect the majority of my body. The nerve painkillers cause agitation, irritability, depression, and even suicidal thoughts. I experience swelling and inflammation, breathing difficulties, blurred or double vision, and instability on my feet. Stopping them suddenly puts me at risk of seizures, nausea, nightmares, and severe withdrawal symptoms. Some medications even increase the chance of blood disorders or future cancers. Others, like Allegron, have led to anxiety, dizziness, sexual dysfunction, and a significant drop in sex drive, affecting future relationships and the possibility of having children. My heart medication, Apo-Propanolol, carries long-term risks of heart, kidney, and brain damage, with studies suggesting potential links to dementia. Even seemingly simple medications like antihistamines can cause liver issues, mood changes, and dependency if stopped abruptly. On top of this, I use constant moisturisers and sunscreens to protect my fragile skin, which weakens it over time and allows chemicals to be absorbed into my bloodstream. Living with these risks and side effects has become a daily balancing act, one that constantly reminds me how far from a normal life I now live.
Many of my family members and hundreds of friends watched and listened to my screams of agony while I was completely engulfed in flames on local and national TV, without warning. They can never unsee or unhear them. They remind me of this whenever I see them after an extended period, which brings tears of anger and resentment to my eyes.
Shut appliance off and allow to cool for 60 minutes before refueling. Flame may be difficult to see - do not assume appliance is off. Always follow shut-off procedure before refueling.
Given the safety requirements for the use and refuelling of the burner, it may be questioned whether the burner is a suitable piece of equipment in a business such as a café, where a number of people may from time to time attend to the use and refuelling of the burner. If every safety instruction was complied with on every occasion of refuelling, little, if any risk, would arise. However, the potential for an employee to not follow all of the safety instructions is real, whether that be because of inadvertence, tiredness, haste or for some other reason.
