Introduction
- On 22 March 2022 the Appeal Panel dismissed two appeals by the Estate of the Late Monica Bouvaird (appellant) concerning a claim for monies following sale of premises in a retirement village at Lindfield to which the Retirement Villages Act, 1999 (NSW) (RV Act) applied, and a dispute concerning charges made by the operator of the village under the relevant contract (contract).
- We published reasons for our decision: Estate of Bovaird v Milstern Retirement Services Pty Ltd [2022] NSWCATAP 75 (Appeal Decision).
- In respect of the Appeals, we made directions permitting the parties to make applications for costs of the appeals. These reasons relate to applications for costs made by Milstern Retirement Services Pty Ltd (Milstern), a respondent in both appeals, and by Estate of the Late Margaret Frost (Frost estate), the second respondent in appeal 2021/00122743.
