reasons for decision
- The applicant seeks a review of a decision of the respondent to cancel a Working with Children Check Clearance ("WWCCC") which had originally been granted to her in January 2017.
- On 30 May 2020, the applicant was charged with common assault allegedly committed on 9 March 2020 on her partner's foster child ("AA").
- The respondent became aware of the charge against the applicant (which related to allegations of 'serious assault'). The respondent conducted a risk assessment and placed an interim bar on her WWCCC because of that charge.
- On 29 May 2021, as a result of the risk assessment, the respondent determined the applicant posed a risk to the safety of children and cancelled her WWCCC ("the Decision").
- On 1 June 2021, the charge against the applicant was dismissed in the Local Court by Magistrate Toose.
Issues
- The main issue for determination is whether the applicant poses a real and appreciable risk to the safety of children.
- If we are satisfied that the applicant does not pose a real and appreciable risk to the safety of children, we then need to consider: 1. whether a reasonable person would allow the applicant to have direct, unsupervised contact with their children; and 2. whether it is in the public interest to grant the applicant a WWCCC.
