(a) any history of family violence, abuse or neglect involving the child or a person caring for the child; and
(b) any family violence order that applies or has applied to the child or a member of the child's family.[26]
What arrangements would promote the safety of the child (including safety from being subjected to, or exposed to, family violence, abuse, neglect, or other harm) of the child and each person who has care of the child (whether or not a person has parental responsibility for the child)
In considering the matters set out in paragraph (2)(a) the Court must include consideration of any history of family violence, abuse or neglect involving the child or a person caring for the child (whether or not the person had parental responsibility for the child) and any family violence order that applies or has applied to the child or a member of the child's family**
The developmental, psychological, emotional and cultural needs of the child**
The capacity of each person who has or is proposed to have parental responsibility for the child to provide for the child's developmental, psychological, emotional and cultural needs**
(a) there is no doubt that the child shares a familiar bond with his father and has transitioned to the visits with ease;
(b) the child refers to the father as "Baba" and has often expressed his love for his father;
(c) physical interaction between the father and the child has been affectionate and loving;
(d) the father has been observed to be patient, loving and attentive. There have not been any concerns noted regarding the father's interaction with the child;
(e) the father has demonstrated exceptional parenting skills including feed the child setting appropriate boundaries, ensuring his safety and attending to his basic care needs extremely well; and
(f) the father has attended the visits extremely well prepared with his own travel bag including toys, activities and healthy home-made food options for the child to enjoy.
The benefit to the child of being able to have a relationship with the child's parents, and other people who are significant to the child, where it is safe to do so**
...
- This situation between [X] and his father is more complex. Prior to separation, [Mr Eglitis] was responsible for providing for the family financially. As a result, he did not have the level of involvement with the child that [Ms Droit] had. There was almost a year where there was no contact between [X] and his father. Currently, their time is limited to six hours per week, and compromised by having a supervisor in attendance. Collectively, throughout his short life, [X] has had far less exposure to his father. In turn, he has not had the benefit of consistent, repeated, and immersive interactions that he has experienced with his mother. [X]'s relationship with his father is far more cursory. There is some degree of familiarity between the child and his father, though there is not a deep sense of connection evidenced by the child. Indeed, [X] has struggled to separate from his mother and transition into the care of his father. [X] may feel a sense of foreignness and displacement in the care of his father over more protracted periods. While I have no doubt that [X] has enjoyed visits with his father since they recommenced, ambivalence is a feature of [X]'s approach towards his father.
- In short, [X] does not have the same sense of connection with his father as he does with his mother. For this reason alone, it is crucial that [X] continues to live mainly in the care of [Ms Droit], at least until he is settled into school, and has had an opportunity to build a more immersive relationship with [Mr Eglitis]. Any change to the child's living arrangement will need to be gradual, to ensure that [X] is able to grow in his connection with his father, and equally, that [Mr Eglitis] can adjust to caring for [X] unassisted. I am not yet of the view that sole parental responsibility is essential, in circumstances where there is little clinical data to demonstrate that [X] has been disadvantaged by his parents' inability to agree on a given course of action. However, if there is not improvement between the parties, this may become a requirement for the child in the years ahead.
...
98 ...
- Ultimately, the question before the court relates to the longer term living arrangements for [X]. As noted previously, [X] is still a very young child, with a far closer bond with his mother. He lacks familiarity with [Mr Eglitis's] provision of care. Still, [X] needs an opportunity to grow his connection to his father, so that he can be raised with the loving input of both parents.
- Having regard to the issues outlined in the preceding sections, I have formed the view that [X] should be spending more time with his father than what presently exists...
