Edmond and Corrigan Pty Ltd v Melbourne CC [2008] VCAT 1065
The decision of the responsible authority is set aside. In permit application
TP-2007-649 a permit is granted and directed to be issued for the land at
138-144 Elgin Street, Carlton. The permit allows buildings and works to the existing building including demolition of the rear and construction of two new levels for 21 student accommodation apartments and waiver of the car parking requirements of the parking scheme in accordance with the endorsed plans and subject to the following conditions:
These amended plans must be to the satisfaction of the responsible authority and when approved shall be the endorsed plans of this permit.
The section 173 agreement must specifically provide for the following:
(a) the accommodation provided on the subject land is to be used for the exclusive accommodation of students enrolled full time at a secondary or tertiary level educational institution and to be vacated within three months of completion of full time studies; and
(b) the building to operate at all times in accordance with the Management Plan as required by Condition 7 of this permit to the satisfaction of the responsible authority. The Management Plan must establish a set of house rules for the use, to be followed thereafter to the satisfaction of the responsible authority. The plan must ensure that a suitably qualified full time manager/lead tenant with responsibility to oversee student behaviour permanently resides on the site and must detail the maintenance, cleaning, garbage storage and collection, supervision and security of the site.
The responsible authority may extend the date upon which this permit expires only if it receives a request in writing before the permit expires, or within three months afterwards.

which variously aim to ensure that new development and the external alteration of buildings:
The project represents an unsustainable use of the land in that there is no clear evidence that such a building could be re-used once the flow of international students ceases, while the failure to provide adequate on-site parking makes adaptive re-use problematical as well.
