- For the reasons given below, I have decided to allow the appeal and to modify the development consent under s 96. As a matter of discretion, it would be unreasonable to refuse the modification application in order to make the applicant lodge a development application for the proposed modified development. Compared with the development as originally approved, the proposed modified development is unlikely to cause any increased demand for public services and amenities.
