East Gippsland SC v Bodey [2017] VCAT 1988
What is the proper characterisation of the use?
Constructing a building or constructing or carrying out works (a shipping container) on the subject land without a permit, contrary to clause 44.04-1 of the East Gippsland Planning Scheme
Use of the subject land for a store without a permit contrary to clause 32.08-2 of the East Gippsland Planning Scheme
Use of the subject land for accommodation without a permit contrary to clause 32.08-2 of the East Gippsland Planning Scheme
[1] The Council has filed statements under sections 140 and 141 of the Planning and Environment Act 1987 (PE Act) that, in summary, prove that at all relevant times since 28 April 2017, the land has been subject to the GRZ and LSIO provisions of the scheme.
[2] Watson v Monash CC [2011] VCAT 2176.
[3] Later in these reasons, I make a finding about the use of the land for accommodation.
[4] Reasoning for this finding is set out later in these reasons.
[5] East Gippsland Planning Scheme cl 72.
[6] Residential Tenancies Act 1997 s 3. This definition is not helpful because it makes reference to a dwelling and dwelling has a particular meaning under the scheme.
