Note: Entry of orders is dealt with in Rule 39.32 of the Federal Court Rules 2011.
(1) Originating Application for Judicial Review - Form 66;
(2) Statement of Claim - Form 17;
(3) Decision of Perram J in Dunkerley v Comcare [2015] FCA 392;
(4) Letter from Comcare to Ms Dunkerley dated 21 December 2022; and
(5) Appeal Book Part C in ACD45/2014,
I will refer to this material collectively as the Documents.
Under rule 2.26 of the Federal Court Rules 2011 ('the Rules'), a document may be refused for filing if a Registrar is satisfied that the document is an abuse of process of the Court. The term "abuse of process" includes an application which has no cause of action properly stated and no prospects of success.
From my review of the Documents, it appears that you are seeking to review a decision of the Court of 27 April 2015 in Dunkerley v Comcare [2015] FCA 392 ('the Decision'). In the application you state that you seek to review the Decision on the basis that the Decision was decided on an error of fact and that there was no evidence or documents before the Court to establish that there was an injury on 15 July 2009. You also claim that his Honour Justice Perram was biased, on the bases of his Honour's comments at paragraphs 26 and 28 of the Decision. You also state that you were not afforded procedural fairness.
I am of the view that the Documents ought to be refused for filing pursuant to rule 2.26 of the Rules on the basis that the Documents do not make out a discernible cause of action properly stated, and that the application has no reasonable prospect of success.
Further, I am satisfied that the Documents are on their face frivolous or vexatious. It would constitute an abuse of process of the Court if they were accepted for filing.
(1) the decision in Dunkerley v Comcare [2019] FCA 1002;
(2) a letter dated 22 November 2024 from Comcare to Ms Dunkerley setting out Comcare's reasons for its decision refusing Ms Dunkerley's request under s 24A of the Freedom of Information Act 1982 (Cth) on the basis that all reasonable steps were taken to locate the documents requested and the decision maker was satisfied that they could not be located or did not exist;
(3) Ms Dunkerley's claim for workers' compensation dated 1 September 2009;
(4) a letter dated 6 January 2021 from Comcare to Ms Dunkerley; and
(5) a document titled "statement of claim" which is identical in content to the "statement of claim" lodged with the Court for filing on 4 October 2025 (see [8] below).
(1) the Registrar breached the rules of natural justice in making the decision;
(2) the Registrar's decision involved an error of law in the suggestion that the filing of the Documents was denied because it "appear[ed] that [Ms Dunkerley was] seeking to review a decision of the Court of 27 April 2015 in Dunkerley v Comcare [2015] FCA 392";
(3) the Registrar failed to take a relevant consideration into account in making her decision;
(4) the Registrar exercised her power in bad faith; and
(5) the Registrar's exercise of power was so unreasonable that no person could have exercised the power in that way.
I certify that the preceding thirty-one (31) numbered paragraphs are a true copy of the Reasons for Judgment of the Honourable Justice Markovic.
