Equal Opportunity Act 1995 - attribute of age- alleged discrimination against contract worker- allegations on which complainant relies found not to be proven.
Drummond v Telstra Corporation Limited (Anti-Discrimination) [2009] VCAT 2411
Did Telstra discriminate against John Drummond because of his age?
(a) in the terms on which the principal allows the contract worker to work;
(b) by not allowing the contract worker to work or continue to work;
(c) by denying or limiting access by the contract worker to any benefit connected with the work; or
(d) by subjecting the contract worker to any other detriment.
"John disagreed with statements, felt group activities were "crap" It's just Telstra's perception of him".
"Following this, Nicole emailed Jeremy Collard on 15 October, stating that she had discussed John with the team leader (Marie Dermatis) and that they had decided to let him go. She requested someone from Kelly's come on site that day to notify John he was no longer required at Telstra. Jeremy forwarded this email to me, and I then contacted Nicole to let her know that I could not just dismiss John and that I had to go through the performance counselling process. We set up a time to do this the following day onsite at Telstra."
"Nicole at first seemed apprehensive but after the process was explained she agreed the process should be followed."
Telstra's alleged noncooperation in discovery and loss of documents
"If a person deliberately destroys documents the strongest possible presumption arises that if it had been produced it would have told against him."
Inferences to be drawn from the failure of Telstra to call potential witnesses
The validity of the agreement between Telstra and Kelly
"Neither the supplier nor its temporary personnel are, and nothing in this agreement will be taken as making either the supplier or its temporary personnel, agents, servants or employees of Telstra."
"I have reasonable grounds for suggesting that I have been treated harshly and have been defamed by Telstra and Kelly."
