(a) First, there is no legislative mandate that plan duration must be 12 months. The NDIS Act does not prescribe a maximum or minimum plan duration, and the Operational Guideline uses permissive language rather than imposing an inflexible rule. > > (b) Second, the applicant's support needs are not subject to change. She does not have a degenerative condition, and the clinical evidence suggests her support needs are stable. > > (c) Third, a longer plan would provide stability and certainty after years of what is considered to be 'underfunding' and would allow more effective progress tracking over a longer period. > > (d) Fourth, the requirement to review the positive behaviour support plan at least every 12 months under rr 21 and 22 of the Restrictive Practices Rules is an obligation that exists independently of plan duration. A longer plan does not prevent such reviews. > > (e) Fifth, check-ins, as described in the NDIS Factsheet on 'Check-ins', provide adequate ongoing oversight without requiring a formal reassessment at 12 months. The Agency can initiate a check-in or reassessment at any point if circumstances warrant it. Accordingly, the applicant contends a 36-month plan duration would not prevent the Agency from conducting an earlier reassessment if circumstances warranted it.
