Judgment (35 paragraphs)
Criminal law - Sentencing - Rape - Victims young children - Director's appeal - Offences committed at primary school - Intelligent "young offender" with significant personality disorder - No prior convictions, full co-operation with police, plea of guilty - Total effective sentence of 6 years and 9 months' imprisonment with non-parole period of 3 years and 9 months - Whether manifestly inadequate - Appeal dismissed.
- In this matter I have had the advantage of reading in draft form the judgment of Phillips, J.A. I would gratefully adopt his Honour's description of the facts of the respondent's offences and of other matters relevant to the sentencing process. I agree with his conclusions upon the arguments actually advanced by the Director of Public Prosecutions.
