The applicant applied to SACAT for review of the respondent's decision to affirm the removal of a child from her care in July 2025 pursuant to section 84(1)(c) of the Children and Young People (Safety) Act 2017 (Child Safety Act). This decision was made subsequent to the Tribunal remitting the original decision for removal made in October 2023 to the respondent for reconsideration.
The applicant made the application to the Tribunal whilst there was an ongoing internal review of the decision being conducted by the respondent under section 157 of the Child Safety Act. The applicant contended that as the original decision of October 2023 had already been internally reviewed, it was open to her to make an application directly to the Tribunal for the review of the decision.
The Tribunal considered whether it had jurisdiction to hear the application as a preliminary matter.

This is an edited version of the Tribunal's decision pursuant to s 60 of the South Australian Civil and Administrative Tribunal Act 2013. Some of the parties and participants of the proceedings have been de-identified in accordance with the Tribunal's anonymisation policy. Other facts and details that may lead to the identification of any person may have also been anonymised or omitted. These changes do not affect the Tribunal's decision or its reasons for decision.
A decision referred to in sub-section (1) will only be taken to be a reviewable decision if a review under s 157 has been conducted in respect of the decision.
[1] Section 158 is drafted in such a way that the review is of the original decision (as confirmed, varied, or substituted) rather than a review of the internal review decision: KJS v Chief Executive of the Department for Child Protection & Anor [2023] SACAT 51 at [26]- [27].
[2] The Tribunal notes that s 37(1)(c)(ii) refers to the "matter" being sent back for reconsideration.
