[9] The amended application for an inquiry also included alleged contraventions of the Estate Agents (Professional Conduct) Regulations 2008 (Vic). At the hearing, CAV informed me findings on those alleged contraventions were not pressed.
[10] In Johnson v Director of Consumer Affairs Victoria [2011] VSC 595, Kyrou J held the scope of an inquiry under s 25(1) of the EA Act is determined by the terms of the document that invokes the Tribunal's jurisdiction and the subsequent conduct of the parties. Any broadening of the initial scope of an inquiry is at all times subject to compliance with the Tribunal's obligations to act fairly and in accordance with the principles of natural justice (see paragraphs 89 to 94).
[11] Those determinations were sought under section 25(1)(a) and (b) of the EA Act. In its amended application, CAV also sought a determination under section 25(1)(c) that Mr Johnson had been guilty of conduct as an estate agent which rendered him unfit to hold a licence. At the conclusion of the hearing, CAV's counsel informed me CAV would not press for that latter determination.
