112 In context, this appears to me to be a further strong indication that the consultancy agreement was not executed until about 24 March 1992 (as appears from the seal register, exhibit 129) or later but that there had been a long-running controversy about the date from which it should be regarded as having effect. The commencement date as drafted (12 April 1990) is not without some significance. It is only shortly before the agreement recorded between Pacific Platinum NL and Waste Recovery Systems Ltd in the letter of 7 May 1990 (exhibit 6) and reflects, in my view, a long-standing attitude by Mr Lunt that he deserved to be treated as a consultant from then on. As I have indicated, this became a stalling point in the negotiations and although the commencement date of 12 April 1990 was apparently approved in the drafts of the document, that did not receive the endorsement of Mr Briggs' sentinel, Mr Czechowski, at the meeting of 22 May 1992. The result was a compromise to put the commencement date a year later, namely 12 April 1991, leading to an amendment of the terms of exhibit 14 to that effect. The commencement date having, by this rather arbitrary process, been set at 12 April 1991, that also became the date of the consultancy agreement, presumably on the theory that the document should bear the date from which it was to take effect, notwithstanding that it was, in fact, not executed until more than 11 or 13 months later.
