Department for Infrastructure and Transport v Reynolds [2025] SACAT 95
The respondent was injured upon being involved in an accident when travelling in an Access Cab. The respondent sought access to CCTV footage from within the Access Cab taken during the event. The Department for Infrastructure and Transport ('the agency') sought to challenge a decision by the Ombudsman which found that the footage was not exempt under the and determined that the respondent should be provided access to it.
The agency contended that disclosure of the footage under the Freedom of Information Act would be contrary to the Passenger Transport Regulations 2024 which prohibits the 'use' of recorded material for an unauthorised purpose.
Held, affirming the Ombudsman's decision that the CCTV footage is not an exempt document:
Administrative Review - Freedom of Information Act 1991 - Agency aggrieved by determination to provide CCTV footage - Where document found to not be an exempt document
Passenger Transport Regulations 2024 regs 79, 86
South Australia Civil and Administrative Tribunal Act 2013 s 37

Affirm decision of the Ombudsman that the CCTV footage is not an exempt document
The agency contends that the answer to this is "no".
The agency contends that the answer to this is "yes"; and
The agency contends that the answer to this is "no".
I draw a distinction between "use" as opposed to "disclose" or" publish". In my view, the agency is not "using" the CCTV footage by disclosing it to the applicant, rather the applicant is prohibited from using the CCTV footage once access is given unless in conjunction with one of the purposes listed above. > > The words "use" and "publication" both appear several times in the PT Act and Regulations. I consider that if Parliament intended to limit the disclosure/publication of CCTV footage it would have used the word "disclose" or "publish". > > In my view, there was no intention of Parliament to control the handling of the information before access is given. The prohibition on the use of the information only arises after access is obtained. Prohibiting disclosure would mean prohibiting accessibility to others outside of the agency and preventing the release of the handling of the information from the agency's effective control. That is not the case here. > > (Footnotes omitted)
A document is an exempt document if it contains matter the disclosure of which would constitute an offence against an Act.
"A person must not use recorded material for a purpose other than an authorised purpose."
(a) a purpose connected with the reporting or investigation of an alleged offence by a police officer or a prescribed officer; or
(b) a purpose connected with the prosecution of, or the issue of an expiation notice in respect of, an alleged offence; or
(c) a purpose connected with the exercise of disciplinary powers exercised by the Passenger Transport Standards Committee under Part 4 Division 5 of the Act; or
(d) a purpose authorised by the Minister for the purposes of these regulations;
Answer: It depends on the circumstances of the disclosure. The prohibition does not include a disclosure by an FOI Officer to an FOI applicant.
Answer: No, if the disclosure does not entail a "use" of the recorded material.
