The subject site is operated by Transpacific Industries (formerly Baxter Limited) predominantly as a landfill operation filling a former sand quarry with clean fill and solid inert waste. Some sales of sand products and composting of green waste occurs on the site but are not the subject of these proceedings.
The permit application seeks to regularise the increase in height of filled areas that exceed previous planning permissions given in 1999.
The enforcement order seeks the landfill to be completed and landscaped in accordance with these previous permissions.

The proposed pre-settlement contour levels are too high after taking into consideration predicted settlement depths and desirable post-settlement contour levels.
Commencement of this permit cancels Planning Permit No. KP97/1009
The continuing operation of the solid insert waste landfill at 649-681 Clayton Road, Clarinda is deemed to be commencement of use and development under this Permit and supersedes any other planning permit over the subject land.
Consequences of the higher contour levels of Area C
...land use outcomes in the non urban area are resolved through structure planning, and are not driven by short term economic expediency but seek to achieve sustainable use and development outcomes[7].
The permit allows the use and development of 649-681 Victory Road, Clayton for the purpose of a solid insert waste landfill and increased pre and post settlement contours in accordance with endorsed plans and permit conditions.
