Davis v Victoria Police (General) [2008] VCAT 1343
For Respondent: Ms R Ellyard of counsel instructed by Victorian Government Solicitor
Class 1 - reports and documents produced by the Respondent in relation to the investigation of bullying complaints at Stawell Police Station (the investigation)
Class 4 - correspondence in relation to the investigation
Document 1 is a report based on the aggregated views expressed by a great number of people who participated in the Assessment. It was created only for the purposes of reporting to the Divisional Superintendent some of the details upon which recommendations were made in order to ensure fairness in terms of these recommendations and demonstrate to him that there was a substantial reason for each of them. It contains information that would clearly identify those who participated and this would then breach the confidentiality and trust that was reinforced to these members at the outset of the Assessment and which formed the basis on which they participated. It also contains very detailed analysis of the evidence given by participants and my opinions of that evidence.
I prepared Document 1 on the basis that it was for the eyes of Superintendent Hendrickson only. I was very frank in the details included in this document because I believed that such frankness was necessary to ensure that there was a certainty and justifiability in terms of the recommendations that had been made. I could not have and would not have been so frank if the document was a document for broader distribution. The nature of the issues contained in the document could only be canvassed in strict confidence and this is the reason for the document being classified accordingly.
Section 30(1) Exemption - Internal Working Documents
(1) Subject to this section, a document is an exempt document if it is a document the disclosure of which under this Act -
(a) would disclose matter in the nature of opinion, advice or recommendation prepared by an officer or Minister, or consultation or deliberation that has taken place between officers, Ministers, or an officer and a Minister, in the course of, or for the purpose of, the deliberative processes involved in the functions of an agency or Minister or of the government; and
Hulls v Victorian Casino and Gaming Authority (1998) 12 VAR 483.
Disclosure of the documents in dispute will advance or promote the public interest in :
(a) clearing the air in relation to doubts about the justification for and propriety of the decision by the Respondent to transfer the Applicant to Geelong Police Station from Stawell Police Station;
(b) holding the Respondent accountable for its decisions relating to the transfer of police members;
(c) helping ensure that the Respondent will act according to due process and the law and will not engage in private vendettas;
(d) denial of natural justice to the Applicant;
(e) righting the injustice done to the Applicant; and
(f) the purity of public administration.
Section 33 Exemption - Information concerning the personal affairs of persons
(a) first that disclosure of the document would involve the disclosure of 'information relating to the personal affairs' of a person; and
(b) secondly, such disclosure would be unreasonable.
Section 35(1) Exemption - Material obtained in confidence.
