Damann Pty Ltd (Deregistered) v Brooker [2025] NSWPICMP 988
WORKERS COMPENSATION - Workplace Injury Management and Workers Compensation Act 1998; claim for permanent impairment; no complaint on appeal about the overall impairment level assessed for left lower extremity (knee); Medical Assessor (MA) made a one-tenth deduction under section 323; extent was the subject of the appeal by the employer; deduction of one-tenth can be made if the deduction is too difficult or costly to assess and this is the MA's reasoning for making the one-tenth deduction; deduction cannot be inconsistent with the available evidence; adequate path of reasoning must also be demonstrated; Medical Assessment Certificate (MAC) must be read as a whole and whilst the MA has referred to the opinion of an independent medical examination (IME) qualified to provide an opinion on behalf of the worker, the MA fails to identify that fact the IME made a deduction of one-half from his assessment of the left knee; MA need not refer to every aspect of the evidence; while MA has to make an independent assessment, the extent of the deduction made by a MA must be consistent with the available evidence; overwhelming consistency of the evidence, demonstrated with the extensive radiological investigations undertaken prior to injury as well as the other medical evidence before the MA and supported by the opinion of the IME; IME qualified to provide an opinion on behalf of the worker; a one-tenth deduction is inconsistent with the available evidence and inadequate to take account of the contribution of the pre-existing injury, abnormality, or injury to the left knee to the overall impairment assessed; Held - MAC revoked.
1 March 2021 (the Guidelines) and the American Medical Association Guides to the Evaluation of Permanent Impairment, 5th ed (AMA 5).
"The following matters have been referred for assessment (s 319 of the 1998 Act):
Chapter, page, paragraph, figure and table numbers in AMA5 Guides
WPI deductions pursuant to S323 for pre-existing injury, condition or abnormality (expressed as a fraction)
Sub-total/s % WPI (after any deductions in column 6)
Total % WPI (the Combined Table values of all sub-totals)
"• Brief history of the incident/onset of symptoms and of subsequent related events, including treatment:
Personal care: Difficulty showering/washing, dressing (uses elastic laces, struggles with shoes/socks)."
Mr Brooker is a 38yo former truck driver. He injured his left knee and lumbar spine loading
a truck on 12/6/2018. He underwent a TKA on 10/12/2018.
He has been unable to return to any paid employment and suffers substantial limitations in his ADLs and social functions.
No inconsistencies identified; mechanism and current impairments concordant with documented injury history"
"The facts on which I have based my assessment of whole person impairment are:
A thorough history, a comprehensive physical examination, a review of the documentation made available by the Personal Injury Commission with reference to the SIRA Guidelines (2021) and AMA-5.
"(a) Is any proportion of loss of efficient use or impairment or whole person impairment, due to a previous injury, pre-existing condition or abnormality?
(b) If so, please indicate which body part/system is affected by the previous injury, pre-existing condition or abnormality. Body part/system affected by prior injury:
Right knee (prior arthroscopy) & pre-existing OA right knee on 2014 films."
"DEDUCTION (IF ANY) FOR THE PROPORTION OF THE IMPAIRMENT THAT IS DUE TO PREVIOUS INJURY OR PRE-EXISTING CONDITION OR ABNORMALITY
a) In my opinion the worker suffers from the following relevant previous injuries, pre-existing conditions or abnormalities:
(i) Left knee: Multi-ACL reconstructions (2004/07/09/10/12), chondral loss, prior arthroscopies, established OA pre-injury.
(ii) Right knee: Prior arthroscopy, OA present pre-injury (X-ray 2014).
(iii) Nil for left shoulder/lumbar spine directly (no pre-existing history documented).
b) The previous injury, pre-existing condition or abnormality directly contributes to the following matters that were taken into account when assessing the whole person impairment that results from the injury, being the matters taken into account in 10a, and in the following ways:
(i) He clearly had some pre-existing degenerative changes in his knees from prior injuries and surgeries but he was working without issue prior to the subject injuries.
The extent of the deduction is difficult or costly to determine so in applying the provisions of s.323 (2) I assess the deductible proportion as one tenth."
"I am in general agreement with the reports of Dr Bodel. We agree that there was pr-existing disease in his knees but that he was working without issue prior to the injuries. At the time of my examination, Mr Brooker describes more severe pain in both knees leading to the poor outcome which is different to when Dr Bodel saw him.
Regarding the report of Dr Miniter dated 4 February 2021, I disagree with much of its content. Mr Brooker presented well at my examination and was cooperative and forthcoming. I do not agree that it is 'simply an arthritic knee' as this statement discounts the rest of the history of injury and subsequential injury.
In his subsequent report of 25 January 2024 he repeats that there is no relationship between 'his workplace episode and the current presentation.'
Therefore, I disagree with the bulk of both reports."
27 COMBINE 15 COMBINE 11 COMBINE 7 COMBINE 1 equals a total impairment of 50% WPI
This Certificate is issued pursuant to s 328(5) of the Workplace Injury Management and Workers Compensation Act 1998.
The Appeal Pane revokes the Medical Assessment Certificate of Medical Assessor John Negus and issues this new Medical Assessment Certificate as to the matters set out in the table below:
Chapter, page, paragraph, figure and table numbers in AMA5 Guides
WPI deductions pursuant to S323 for pre-existing injury, condition or abnormality (expressed as a fraction)
Sub-total/s % WPI (after any deductions in column 6)
Total % WPI (the Combined Table values of all sub-totals)
The above assessment is made in accordance with the SIRA NSW Guidelines for the Evaluation of Permanent Impairment for injuries received after 1 January 2002.
