DECISION
- On 23 June 2022 Heather Cross commenced proceedings against the Secretary of the Department of Education ("Secretary") by filing an application pursuant to s 84 of the Industrial Relations Act 1996 ("IR Act"). Through a notice of motion filed on 23 August 2022, the Secretary sought an order that Ms Cross's application be dismissed ("Motion"). The Secretary contended in the Motion that Ms Cross was not dismissed or, if the Commission found that she was dismissed, her application was filed out of time.
- On 7 November 2022 I ordered that the Motion be dismissed: Cross v Secretary of the Department of Education [2022] NSWIRComm 1096 ("Decision").
- Ms Cross has applied for an order that the Secretary pay on an indemnity basis her legal costs associated with resisting the Motion ("Costs Application"). The Costs Application is brought pursuant to s 181 of the IR Act.
Determination
- I have determined to dismiss the Costs Application. The basis on which I have done so is set out below.
