Background 5. The dispute in the substantive proceedings concerned, in summary, a personal guarantee signed by the defendant in respect of any amount due or owing by Comsta Pty Ltd, a corporation of which he was the sole shareholder and director, to the plaintiff. The plaintiff claimed $340,451.02 plus interest in respect of printing services provided on the basis of the guarantee and misleading and deceptive conduct, or unconscionable conduct, on the part of the defendant.
