Automatic cancellation--recipient not complying with subsection 68(2) notice
(1) Subject to subsection (2), if:
(a) a person who is receiving a social security payment is given a notice under subsection 68(2); and
(b) the notice requires the person to inform the Department of the occurrence of an event or change of circumstances within a specified period (the notification period); and
(c) the event or change of circumstances occurs; and
(d) the person does not inform the Department of the occurrence of the event or change of circumstances within the notification period in accordance with the notice; and
(e) because of the occurrence of the event or change of circumstances:
(i) the person ceases to be qualified for the social security payment; or
(ii) the social security payment ceases to be payable to the person;
the social security payment is cancelled, by force of this subsection, on the day on which the event or change of circumstances occurs.
I am satisfied the various notices sent to the Applicant before and during the debt period, requiring her to notify within 14 days of events or changes of circumstances affecting her YAL, were authorised by and given under subsection 68(2) of the Administration Act. She did not inform Centrelink within 14 days that she was no longer studying full-time. As a consequence of ceasing full-time study, she was no longer qualified for YAL since there is no evidence she otherwise satisfied the activity test for this payment.
Waiver if there was an unclaimed entitlement to parenting allowance or parenting payment
(a) a debt arises from overpayments to the debtor; and
(b) the Secretary is satisfied that the overpayments did not result wholly or partly from the debtor or another person knowingly:
(i) making a false statement or false representation; or
(ii) failing or omitting to comply with a provision of this Act or the 1947 Act; and
(c) the debtor or the debtor's partner did not claim parenting allowance or parenting payment for the period (the overpayment period) when the overpayments were made; and
(d) an amount of parenting allowance or parenting payment would have been payable for that period if the debtor or the debtor's partner had lodged a claim;
the Secretary must waive the right to recover the debt to the extent set out in subsection (5).
The critical issue for me to consider under this provision is whether the overpayments resulted from the Applicant "knowingly" either making a false statement or representation or failing or omitting to comply with a provision of the Act. The 1947 Act has no application in this case and there is no evidence any other person might have made any relevant false statement or representation or failed to comply with the Act's provisions.
Situations where allowance not payable for failure to comply with certain requirements
The Secretary relies on section 68 in this context. Again, however, it seems to me that, while subsection 68(2) of the Administration Act authorised the giving of notices which required the Applicant to notify of changes of circumstances affecting her YAL within 14 days, section 68 itself did not impose any such requirement on the Applicant.
