Costa & Ors v Glen Eira CC & Anor [2013] VCAT 563
In the absence of identification of land having the benefit of the covenant that no building other than a dwelling house shall be erected on the land, either by such benefitting land being named or rendered identifiable by some test or formula expressed in the covenant, I conclude that there is no land enjoying that benefit. The same is true of the other promises in the encumbering terms in the relevant transfer of land.

It is trite law but the primary duty of the court in construing a written contract is to endeavour to discover the intention of the parties from the words of the instrument in which the contract is embodied. Of course the whole of the instrument has to be considered, since the meaning of any one part of it may be revealed by other parts, and the words of every clause must if possible be construed so as to render all of them harmonious one with another. If the words used are unambiguous the court must give effect to them, notwithstanding that the result may appear capricious or unreasonable, and notwithstanding that it may be guessed or suspected that the parties intended something different. The court has no power to remake or amend a contract for the purpose of avoiding a result which is considered to be inconvenient or unjust.
. the meaning of the covenant is determined by its language and context of the actual document;
. it must be interpreted strictly and literally because it now affects parties who were not contracting parties to the original document;
. extrinsic evidence is not relevant to the interpretation of the document;
