[1] The applicant defendant as contractor and the respondent plaintiff as subcontractor entered into a subcontract ("the Subcontract") to perform certain works in relation to the construction of an ammonium nitrate plant at Moura. On 5 March 2001 the respondent commenced proceedings against the applicant in the Supreme Court of Victoria claiming $1,661,654 damages for breach of contract. The proceedings were transmitted to Queensland and an Amended Statement of Claim was filed on 2 August 2005. In it a number of discrete claims were made. The applicant seeks summary judgment in respect of the following three claims:
