s.437 - Application for a protected action ballot order
Construction, Forestry and Maritime Employees Union
Proposed protected action ballot of employees of Crane Services Pty Ltd - non-AEC ballot electronic voting
[1] This is an application by the Construction, Forestry and Maritime Employees Union (CFMEU or Applicant) made under s.437 of the Fair Work Act 2009 (Act) for a protected action ballot order in relation to certain employees of Crane Services Pty Ltd (Crane Services or Employer).
[2] On 6 March 2026, the Commission was advised that the Employer did not object to the Application, but did object to the length of the ballot period proposed by the CFMEU - being that the ballot would close on 14 March 2026. The CFMEU subsequently provided an amended draft order in which it proposed that the ballot would conclude on 19 March 2026. The Employer maintained that the ballot period should be 10 working days after any order; being, 24 March 2026, and it sought to be heard.
[3] In the circumstances, I conducted a hearing today to determine the matter.
[4] On the basis of the material before me, including the declaration of Travis Hera Singh, Branch Executive Office, setting out the steps taken by the CFMEU in bargaining with the Employer and that it has been, and is, genuinely trying to reach agreement with Crane Services, I am satisfied that there is a notification time in relation to the proposed agreement and that all of the requirements in s.443(1) of the Act have been met.
[5] The ballot is to be conducted by Fair Vote Services Pty Ltd (Fair Vote). Fair Vote has been approved as an eligible protected action ballot agent under s.468A of the Act and is authorised to conduct the ballot.
[6] For the purposes of s.443(3)(c) of the Act, the Commission has determined that the date by which voting is to close is. This also establishes the ballot period for the purpose of s.448A(2) of the Act. The CFMEU revised position proposed, in effect, a 7 working day period. It contended that the ballot is to be done expeditiously as practicable, the ballot itself will be held electronically and could readily be undertaken in that period, and that Crane Services have not submitted evidence that would justify a longer period or which suggests they would be unavailable to attend a section 448A Conference as required.
[7] Crane Service did not seek a specific period but raised concerns regarding the CFMEU's proposed ballot period being less than the "usual 10 business day ballot period". It submitted that that any less that the 10 business days would "materially prejudice the Company [Crane Services] ability to review the matters raised by the CFMEU", "Communicate with employees across workforce", and "Meaningfully participate in any conference or further processes before the Commission".
[11] An Order has been separately issued in PR797443.
[12] This matter will be assigned to another Member of the Commission to conduct the s.448A compulsory conciliation conference. That Member will issue an Order requiring the attendance of all bargaining representatives in the proposed enterprise agreement at the conference. It is likely that Directions will also be issued to ensure that the parties attend the conference ready to conduct meaningful negotiations.
