s.739 - Dispute resolution

Dispute regarding clause 8.9.8 of the Australian Amalgamated Terminals Pty Ltd Enterprise Agreement 2025.

• [1] The Maritime Union of Australia Division of the Construction, Forestry and Maritime Employees Union (Applicant) and Australian Amalgamated Terminals Pty Ltd (Respondent) have disputed the rights of the MUA Delegate to attend the International First Nations Maritime Workers Conference (the Conference) under clause 8.9.8 of the Australian Amalgamated Terminals Pty Ltd Enterprise Agreement 2025 (the Agreement) which provides that:

"Site delegates/union representatives may, upon the request of the union, be granted paid time off work up to a national maximum of twenty days per year (non-cumulative) at normal, ordinary pay rates (seven hours). Such paid leave is for the purpose of undertaking training which is necessary to assist the delegate/union representative in his or her dispute resolution role. The twenty days as aforementioned may be extended via agreement between the parties."

• [2] The Respondent has accepted that the MUA Delegate's attendance at the Conference would be covered by clause 8.9.8 of the Agreement and the Applicant has agreed to resolve the dispute on this basis.
