Judgment (16 paragraphs)
- The application for modification is to extend the extraction area by approximately 5,450 square metres on the northern side of the approved area so as to extract approximately 100,000 tonnes of material at the existing rate of 20,000 to 25,000 tonnes per month. This means that the additional area will be exhausted of basalt resources within four to five months.
- The purpose of the application is to enable the applicant to obtain supplies of basalt on an interim basis so as to sustain its operations until a determination is made on a separate application for a quarry on other land nearby and which has been the subject of a Commission of Inquiry.
