The Applicant has also relied on the reasons of the Building Appeals Board (BAB) in Owners Corporations 1-4 v Baxas.[1] In that matter, the BAB considered the terms 'latch' and 'manual release' and whether an electromagnetically operated latch meets the criteria given under AS 1926.1.
We have had regard to the BAB's reasons in Owners Corporations 1-4 v Baxas in determining the application before us. However, we will not repeat those reasons here.
We have also had regard to the emergency procedures in place (see paragraph 7 above) and on that basis find that the existing doorset (D37) with an electromagnetic latch, and an electronic card reader installed at a height of 1500mm from the FFL comply with the Performance Requirement Vic GP1.2(a) to the extent it relates to the doors forming part of the swimming pool barrier.

Compliance Assessment Application - An application pursuant to s 160A of the Building Act 1993 for a determination that the existing doorset (D37) with an electrically operated latch and forming part of the swimming pool enclosure in a Class 2 building, complies with the Performance Requirement Vic GP1.2(a) of the Building Code of Australia 2016, Volume One - Australian Standard 1926.1-2012 and Owners Corporations 1-4 v Baxas [2020] VBAB 55 considered and applied.
