Henry, an employee of Allied Engineering, was injured after falling from unstable and unsafe planks constructed as scaffolding in a chute at Adelaide Brighton Cement's plant - Complete Scaffold were contracted by Adelaide Brighton Cement to provide and erect scaffolding at Adelaide Brighton Cement's premises - Henry obtained a judgment in the District Court for damages against Complete Scaffold. The trial Judge made a number of findings of fact related to Complete Scaffold's involvement in constructing the scaffolding - Judge found the evidence of Henry and a number of his co-workers that Complete Scaffold had erected the scaffolding was reliable - whether the trial Judge erred in accepting this evidence - whether inconsistencies in the sequence of events suggested that the finding that Complete Scaffold erected the scaffolding was incorrect - appeal dismissed.
