A lawyer was reprimanded and ordered to complete extra training after the Victorian Legal Services Commissioner found he failed to properly disclose costs to a family law client, breached confidentiality by copying a third party on fee-related emails, and sent a threatening email saying he would report the client to her employer. The Commissioner's investigation also reduced the client's legal bill from over $4,300 to approximately $2,060 after determining this was the fair and reasonable amount for the work performed.

Citation: Commissioner Determination (Breach of confidentiality, no costs disclosure) [2018] VLSC 21
I consider the amount of legal costs that are fair and reasonable in all circumstances in relation to the Bills to be $2,064.20 (including GST and disbursements), which the Complainant must pay the Law Practice.
Accordingly, I have determined that $2,064.20 (including GST and disbursements) represents the fair and reasonable legal costs, which amounts to a reduction of $935.80 from Bills 1 and 2 and $2,241.80 from Bill 3. On this point I note that the Complainant has already paid the sum of $1,500.00 to the Law Practice.
The Respondent Lawyer further stated that he only copied Ms K into emails regarding outstanding fees, and all three parties were aware of that issue and no further confidential information was discussed with Ms K.
