- These proceedings arise out of arbitration proceedings before Mr Brian Gallagher. As I have reached a clear view concerning the disposition of them, I propose to give judgment immediately.

- I am indebted to the legal representatives of Command for the background summary contained in their outline of argument which I adopt and adapt for the purposes of these reasons. I note at the outset that the first stage of the arbitration proceedings is now scheduled to commence in November 1999 and that the court should be loath to do anything to disturb that date without good and substantial cause.

- There are in effect four parties before the court: namely, Command Energy Pty Ltd, (Command); Fletcher Construction Australia Limited, (Fletcher); Varnsdorf Pty Ltd, (Varnsdorf); and TB Pty Ltd and TBI Pty Ltd, collectively DETCO.
