Introduction
- This decision arises out of an appeal and a cross-appeal. At first instance the Tribunal was exercising its jurisdiction under the Home Building Act 1989 (NSW) (the HB Act). Mr & Ms Sarkis, as homeowners, had brought an application against Colourrender (Australia) Pty Ltd in respect of rendering work undertaken at their residence at an address in Sydney, New South Wales. That application resulted in the decision under appeal published on 29th June 2022 (the Decision) by which the Tribunal ordered Colourrender to pay to Mr & Ms Sarkis the sum of $76,660 and costs.
- Colourrender appeals the orders made and Mr & Ms Sarkis have lodged a cross-appeal. We will refer to the Appellant, Colourrender, as the "Builder." We will refer to Mr & Ms Sarkis, the Cross-Appellants as the "Homeowners."
