FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (DIVISION 1)
Note: The form of the order is subject to the entry in the Court's records.
Note: This copy of the Court's Reasons for judgment may be subject to review to remedy minor typographical or grammatical errors (r 10.14(b) Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth)), or to record a variation to the order pursuant to r 10.13 Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth).
Part XIVB of the Family Law Act 1975 (Cth) makes it an offence, except in very limited circumstances, to publish an account of proceedings that identify persons, associated persons, or witnesses involved in family law proceedings.
IT IS NOTED that publication of this judgment by this Court under a pseudonym Unterbrink &Unterbrink has been approved pursuant to subsection 114Q(2) of the Family Law Act 1975 (Cth).
(a) as was held in Fitzgerald v Fish[24] only one of the matters in s 114UB(3) needs to be relied on for a party to seek an order that deviates from the more usual order under s 114UB(1) of the Family Law Act;
(b) while seven separate matters are set out in s 114UB(3) being matters to which "the court mut have regard", as was held in Sean Investments[25] I am required to consider each according due weight to each but I ultimately have a discretion in their application; and
(c) according to In the Marriage of Gyselman,[26] I am not required to slavishly go through each of the subparagraphs of s 114UB(3).
"As the Applicant contends, the Respondent has a 25% interest in the clothing partnership business known as '[B PARTNERSHIP]' located at [Property C], India ("[B Partnership]") from where she is entitled to profits which are deposited into her Capital account with B Partnership. The Respondent has resisted to provide full and frank disclosure as to her interest in B Partnership."
I certify that the preceding thirty-four (34) numbered paragraphs are a true copy of the Reasons for Judgment of the Honourable Justice Wilson.
