Cluse v McInnes [2025] SACAT 96
This decision deals with an application for the Tribunal to terminate a residential tenancy agreement on the basis that the tenant has committed a sufficiently serious breach to justify termination, pursuant to section 87 of the Residential Tenancies Act 1995 (the Act).
The agent, on behalf of the landlord, submitted that the tenant had denied access to the property on four occasions where the agent sought to undertake an inspection or address maintenance issues. The agent told the Tribunal that access had been denied despite compliance with the requirements under section 72 of the Act.
The tenant had previously denied the agent access unless he obtained an order from the Tribunal. He otherwise denied he had received the required written notices regarding the inspections and denied access because he believed the agent would undertake maintenance work for which he was unqualified.
