Application for approval of the Cleanaway Central West Enterprise Agreement 2025

[1] Cleanaway Operations Pty Ltd has applied for approval of a single enterprise agreement known as the Cleanaway Central West Enterprise Agreement 2025 (the Agreement).

[2] Written undertakings have been given in accordance with section 190 of the Fair Work Act 2009 (Act) and are attached at Annexure A. I am satisfied that the undertakings are not likely to cause financial detriment to any employee covered by the Agreement or result in substantial changes to the Agreement. The undertakings are taken to be terms of the Agreement.

[3] With the undertakings now given, and having regard to the Statement of Principles,[1] I am satisfied that each of the requirements of sections 186, 187, 188 and 190 of the Act, as are relevant to this application for approval, have been met.

[4] The Agreement is approved and will operate from 17 March 2026. The nominal expiry date of the Agreement is 30 June 2028.

[5] In accordance with s.205A(2) of the Act, the workplace delegates' rights term in the Waste Management Award 2020 is taken to be a term of the Agreement.

[6] The Agreement covers the Transport Workers' Union.

[7] I consider it appropriate to vary the Agreement on my own initiative to correct obvious numbering errors in relation to clause 41. References to clause 40.5 in the Agreement will be read as references to clause 41 with sequential renumbering of clauses appearing after clause 41. A revised version of the Agreement correcting the errors is published with this decision.
