CKT v Registrar of Firearms [2025] SACAT 108
The applicant lodged an application with the Tribunal to review the Registrar of Firearms' decision to refuse his firearms licence application. The applicant had previously held a firearms licence which was cancelled pursuant to s 20(7) of the Firearms Act 2015 (the Act) as a result of the applicant's commission of a prescribed offence. As a result, the applicant was prohibited from applying for a firearms licence for a period of five years. Upon applying for a new firearms licence, the Registrar required the applicant to provide a report from a psychiatrist, and three character references. A psychiatrist report was not provided by the applicant, instead a GP Management Plan was produced. The Registrar refused the application pursuant to s 15(1) of the Act on the grounds that the applicant was not a fit and proper person to hold a firearms licence. The applicant also submitted an historical psychologist report and argued the request for a psychiatric report was outside the scope of the Registrar's powers under s 53 of the Act. The Registrar considered the psychologist report but maintained the opinion that the applicant was not fit to hold a firearms licence given the lack of current evidence of the applicant's mental health before the Registrar.
