1 ALLANSON J: The defendants are the registered proprietors of 337 Sydenham Street, Belmont (No 337). They were registered on the title as tenants in common in equal shares on 8 August 2014. There are two encumbrances on the title, including an easement granted to the City of Belmont and registered on 9 July 1993.
2 The City has authorised the occupiers and invitees of Lots 2 and 3, the rear lots on the adjacent land at 339 Sydenham Street (No 339), to use the easement as their means of access from the street, including vehicle access to parking on those lots. The easement is the only current means of access.
