1. This is an application for leave to appeal from a decision of the ACT Civil and Administrative Tribunal (ACAT). The ACAT decision was made in an application to review a decision made by the respondent, the ACT Planning and Land Authority, under the Planning and Development Act 2007. Section 86 of the ACT Civil and Administrative Tribunal Act 2008 provides that an appeal from such a decision lies only on a question of law, and only with the leave of this Court.
