- The applicant in the proceeding and the respondent to the summons, CGU Workers' Compensation (Victoria) Limited ("CGU") is a company which carries on business as an insurer.
- On 25 May 1999, CGU issued a notice of motion for winding up Carousel Bar in insolvency. In order to prove insolvency CGU relies on the alleged failure of Carousel Bar to comply with a statutory demand to pay a debt.
- CGU alleges that Carousel Bar owes it premiums for WorkCover insurance for three years from 1 July 1996 to 30 June 1997, together with interest. The total amount of the alleged debt is $8,895.96. CGU alleges that the demand was served by pre-paid post, addressed to Carousel Bar Pty Ltd, 32 Hardy Street, Lilydale VIC 3140 on 26 March 1999. At that time it was believed that the registered office of Carousel Bar was the said address.
