s.789FC - Application for an order to stop bullying
Application for an order to stop bullying at work - whether bullying occurred while at work in a constitutionally covered business
[1] On 4 November 2025, Mr Colin Carter applied for orders to stop bullying at work under s.789FC of the Fair Work Act 2009 (the Act) in relation to his employment at Canning Vale College (the College). The College is a public school in Western Australia, and Mr Carter is employed by the State of Western Australia (WA).
[2] For the reasons given by Hampton C in the case of Ms S.W.[1], the College is not a constitutionally-covered business. Mr Carter could not have been 'bullied at work' within the meaning of that phrase in s.789FD(1) of the Act. The Commission does not have jurisdiction to deal with the application.
