(a) CBB's online audit was conducted consistent with the audit pathway set out by the Commission and the absence of a site inspection does not make it deficient. The Respondent's suggestion that it is deficient ignores the explicit flexibility of the audit pathway for new or non-service delivering providers. > > (b) Further, conditional registration which involved a follow-up audit could have been granted, rather than refusal of the application, and would have been an appropriate way of dealing with concerns related to higher-risk supports. > > (c) Other providers who have provided similar duplicate responses in their applications have been granted registration subject to follow-up audits. Refusal of this application in similar circumstances raises concerns of unequal administrative treatment and lack of transparency in decision-making. > > (d) There is no evidence that the independently prepared self-assessment report addressing all core and supplementary NDIS Practice Standards was taken into account during the internal review decision, raising issues of fairness and integrity of the decision-making process. > > (e) 'Suitability', construed in the context of the NDIS Registration Rules, does not include visa status. In addition, the Director's 5+ years' experience and CBB's Key Personnel's 21 years' experience demonstrate both capability and suitability. > > (f) Introducing the new grounds such as visa status and audit method as part of Tribunal proceedings is not procedurally fair as CBB has not been given adequate notice or opportunity to respond.
(a) Ms Sharma, as CBB's sole Key Personnel, is not suitable because she does not have sufficient qualifications, skills or experience to provide supports or services to people with disability, and > > (b) Ms Sharma, as CBB's sole Key Personnel, is not suitable because her visa is temporary and CBB has not provided satisfactory evidence that continuity of care would be provided to NDIS participants if Ms Sharma is unable to remain in Australia.
(a) 2 years' experience as a Personal Care Assistant in Warrandyte > > (b) Gardens Care Community (aged care) > > (c) 6 months' experience as a PCA in Regis Aged Care > > (d) 6 months' experience as PCW in Arcare Home Care > > (e) 1 year's experience as a PCA at CaSPA Care > > (f) Currently working as a Disability Support Worker
Conclusion on qualifications, skills and experience
The documentation submitted by the service provider, Caring Beyond Bounds Pty Ltd, reveals their fulfillment of the following requirements pertaining to continuity of support: > > The development of the Continuity of Support Policy and Procedure, ensuring each participant's access to timely and appropriate support without interruption. > > In the event of worker absence or vacancy, the policy includes a plan for continuity of supports, specifying that a suitably qualified and/or experienced person will step in to perform the role, ensuring uninterrupted support for participants. > > The provider ensures that supports are meticulously planned with each participant to meet their specific needs. > > These needs and preferences are documented and shared with workers before their engagement with the participant, guaranteeing that the participant's experience aligns with their expressed preferences. > > In situations where changes or interruptions are inevitable, the policy outlines that alternative arrangements will be communicated to the participant. The provider seeks agreement from the participant regarding the proposed changes or arrangements, ensuring their understanding and consent. > > Additionally, the policy recognizes the significance of disaster preparedness and planning. It articulates that measures are in place to facilitate the continuation of critical supports before, during, and after a disaster, where applicable.
